1. Accounts

(a) To use the portal, every Customer needs an account. You are responsible for insuring your login credentials remain confidential. You are responsible for all activity that happens under your account. Let us know immediately if you suspect unauthorised access.

(b) You are responsible for ensuring appropriate person(s) are assigned administrator permissions within the DutyGO website.

2. Acceptable use

You agree not to:

  • Use the service for any unlawful purpose, or to harass, abuse, or harm another person
  • Attempt to gain unauthorised access to other accounts, clubs, or our systems
  • Upload false duty records, qualifications, or check-in data
  • Interfere with or disrupt the integrity or performance of the service

3. Customer responsibilities

The Customer is responsible for the accuracy of the staff records added by it or on it's behalf, for obtaining any consents needed to add members to the roster, and for promptly removing members who should no longer have access.

In data protection terms you are the controller for your members' data and we are your processor. What that means in practice - our security commitments, our sub-processors, breach notification, and deletion on termination - is set out in the Data Processing Addendum, which forms part of these Terms.

You may add members under 18 to a roster. If you do, you are responsible for having a lawful basis for holding their data and for obtaining any parental consent you or your governing body require. We design the service so that it is safe for under-18s to use - email addresses are hidden from the roster by default, and we carry out no profiling, tracking or advertising - but the decision to add a young person, and the consent behind it, is yours.

You must not record medical information, safeguarding records, DBS results, or other criminal offence data in DutyGO and entering it is a breach of these Terms.

4. Subscriptions & payment

(a) Payment for the Starter and Pro plans (as set out on the website) are payable by the Customer in advance on a recurring basis (monthly or annually) as agreed by the Customer at checkout ("billing period"). Payment is effected through Stripe and the method of payment is to be agreed between the Customer and Stripe.

(b) Prices may change with reasonable notice.

(c) Unless stated otherwise, fees are non-refundable for partial billing periods.

(d) Payment for custom services (referred to as Enterprise on the DutyGO website) to be agreed between the parties and payed for via Stripe before we provide these services.

5. Service availability

We shall use reasonable care and skill to maintain the availability of the website. We do not guarantee the website will be uninterrupted or error-free. We may suspend access for maintenance, security, or legal reasons, and will give notice where reasonably possible. We make no representations about the suitability of the website or DutyGO for any purpose.

6. Your data

You retain ownership of the data entered into DutyGO by you, or on your behalf. We process it as described in our Privacy Policy and, where we act as your processor, on the terms of the Data Processing Addendum. You can export your staff data at any time using the built-in CSV export feature.

We will notify you without undue delay, of any personal data breach affecting data we process on your behalf. Retention periods for every category of data we hold are published in Section 8 of the Privacy Policy.

7. Intellectual property

DutyGO, its software, design, and branding are owned by Firebound Interactive. These Terms do not grant you any rights to, over or in relation to our intellectual property. No part of the website may be reproduced in any form without our prior consent, other than temporarily in the course of using DutyGO for personal use or to keep a record for personal use.

8. Limitation of liability

(a) To the fullest extent permitted by law, DutyGO is provided "as is" without warranties of any kind.

(b) We are not liable for indirect, incidental, or consequential damages arising from your use of the service, including (but not limited to) missed duties, scheduling errors, or data loss, except where liability cannot be excluded by law.

(c) In any case whatsoever our liability is limited to the amount payed by you to use DutyGO per month.

9. Termination

(a) You may stop using the service at any time by giving notice by cancelling the subcription on the DutyGO website. Thereafter, no further charges shall apply. No refunds shall be given for any remaining time within a period already payed for. You shall have access to DutyGO for the remaining period for which you have payed.

(b) We may suspend or terminate accounts that breach these Terms, including (but not limited to) breach of clause 2 herein. Without prejudice to any of our other rights, we shall not refund any amount payed for a billing period.

(c) If a payment fails and remains unresolved for more than 24 hours, the Customers access to your club is locked for all it's members until payment has been received by us. Your data is not affected while locked, and access is restored automatically once payment succeeds. If payment is not received by the end of the billing period, we may terminate the Customers account.

(d) We may terminate the Customers use of DutyGO upon 14 days notice to the Customers email that was provided during registration. Upon giving 14 days notice, at which time the customer shall be refunded payments made on a pro rata basis.

10. Changes to these Terms

We may update these Terms from time to time. Continued use of the service after changes take effect constitutes acceptance of the revised Terms.

11. Governing law

These Terms are governed by the laws of England and Wales, and any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.

12. Severability

If, in any legal proceedings, it is determined that any provision of these Terms is unenforcable under applicable law, then the unenforcable provision shall automatically be amended to conform to that which is enforceable under the law. In any event, the validity or enforceability of any provision shall not affect any other provision of these Terms, and these Terms shall be construed and enforced as of such provision had not been included.
